How Michigan’s No-Fault System Treats Motorcycle Riders

Motorcycle accident cases in Michigan don’t follow the same rules as car accident claims, and that distinction matters from the moment a crash happens. Under state law, motorcycles are excluded from the no-fault insurance system as motor vehicles. Riders don’t automatically receive personal injury protection (PIP) benefits the way car drivers do.

Michigan follows modified comparative negligence, which means a rider can still recover compensation even if partially at fault, provided their share of fault doesn’t exceed that of the other parties combined. Under MCL 600.2959, noneconomic damages are barred only if the rider’s fault exceeds 50 percent.
